Terms of Service and Competition Rules and Regulations
OVERVIEW
These Terms of Service (“Terms”) govern your (“you” “your” “competitor”) access to and use of the DigitalHorseShow.com LLC (“DHS”) website and participation in our online DHS competitions (“Competitions”). Our DHS Competitions are run utilizing the basic principles and rules for competition of the United States Equestrian Federation (“USEF”). Should an instance occur that is not covered under the USEF rules, DHS and the judge will have the final decision.
DHS COMPETITION RULES
Each DHS Competition will be conducted online. As a competitor, you will compete at home over courses set to specifications posted on the DHS website and will video your rounds and submit them through the DHS entry platform to be judged. Each hunter and equitation division will consist of two (2) over fences classes and one (1) flat or under saddle class. The judge’s decision is final.
Horses should be shown in the appropriate tack as required under the USEF rules for the division in which they are competing (i.e. Hunters or Equitation). Braiding is not required.
Competitors should be neatly attired. Polo Shirts are allowed, breeches must be approved show colors, and jackets are not required.
Each competitor will be judged and receive a numerical score for each over fence class submitted. Flat classes will be judged on one lap around in each direction at the trot and the canter and each entry will receive a numerical score from the judge.
It is the competitor’s responsibility to set the course to the specifications (i.e., heights, widths, and distances for related jumps) on the course chart provided for each competition. The specifications for each course will set forth heights, widths, distances, and the basic materials needed to build the course. The competitor is responsible for any and all materials they provide and use to build the course. It is strongly recommended that the course be built using industry best practices for safety, such as the use of safety jump cups. The competitor sets the course and participates in the Competition entirely at his or her own risk and DHS is not responsible in any way for any accident, injury, loss, or death resulting from or related to signing up for or participating in a DHS Competition.
The course specifications will also indicate the preferred location for the camera operator to stand while recording the round. We know that it may not be possible to shoot from that position in every ring, however we would like the judge to able to evaluate each round from a similar viewpoint, so try to get as close as possible to the location on the course chart. Shooting from the ends of the arena is not a good location.
Soundness. All horses must trot a circle on a loose rein either prior to or after the round as a soundness check. Any horse deemed not serviceably sound by the judge or show signs of abuse will be eliminated and forfeit any entry fees paid.

VIDEO TERMS
All videos submitted by the deadline will be reviewed by the judge prior to being posted to the public on the DHS website.
By submitting a video, you grant DHS the absolute and irrevocable license to use, re-use, publish, and re-publish the video(s) you submit in whole or in part, including alterations on the website and other electronic and social media and in conjunction with any copyrighted matter, in any and all media now or hereafter known for display, illustration, promotion, advertising, and informational and educational purposes and to copyright the same under DHS’s name. You hereby release and discharge DHS from any and all claims and demands arising out of or in connection with the use of the videos, including without limitation any and all claims for invasion of privacy, right of publicity, or claim of compensation.
If you choose to include the image or voice of other people in your submission, you are responsible for obtaining the necessary releases from those individuals and must be able to provide copies of those releases to DHS upon request.
ONLINE COMMUNITY
Comments made using the Chat Features of DHS should be kept to a positive tone. DHS may delete any comments that the DHS feels are inappropriate or bullying. One warning shall be received for inappropriate comments and additional offenses may result in a member’s account being terminated and any fees paid by the Competitor or User/Member will be forfeited.
WHAT WE COLLECT
When you sign up for an account on the DHS website, we may collect certain information about you such as your name, address, email, and other contact information or personally identifiable information. We may use that information for the purposes for which it was submitted, to conduct DHS business, or to share information that we think might be of interest to you. We will not share your information with third parties without your prior consent.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DHS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE DHS; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF DHS EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID DHS, IF ANY, IN THE PAST SIX MONTHS FOR PARTICIPATING IN DHS COMPETITIONS GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE DHS HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
For and in consideration of Digital Horse Show (DHS) allowing me, the undersigned, to participate in any capacity (including as a rider, lessee, owner, agent, coach, official, trainer or volunteer) in a DHS event or activity, including but not limited to equestrian clinics, practices, shows, competitions and related or incidental activities; I, for myself, and on behalf of my spouse, children, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors,, and assigns, hereby agree to and make the following contractual representations pursuant to this Agreement (the “Agreement”):
A. RULES AND REGULATIONS: I hereby agree to be bound and abide by the rules, regulations, and policies of DHS as published in the DHS Terms and Conditions and on the website at http://www.DigitalHorseShow.com, as amended from time to time.
B. ACKNOWLEDGMENT OF RISK: I knowingly, willingly, and voluntarily acknowledge the inherent risks associated with the sport of equestrian and know that horseback riding and related equestrian activities are inherently dangerous, and that participation in any DHS Event involves risks and dangers including, without limitation, the potential for serious bodily injury (including broken bones, head or neck injuries), sickness and disease (including communicable diseases), trauma, pain & suffering, permanent disability, paralysis and death; loss of or damage to personal property (including my mount & equipment) arising out of the unpredictable behavior of horses; exposure to extreme conditions and circumstances; accidents involving other participants, event staff, volunteers or spectators; contact or collision with other participants and horses, natural or manmade objects; adverse weather conditions; facilities issues and premises conditions; failure of protective equipment (including helmets); inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the DHS Event organizers and competition management; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”).
EQUINE ACTIVITY LIABILITY ACT WARNING:
CAUTION: HORSEBACK RIDING AND EQUINE ACTIVITIES CAN BE DANGEROUS. RIDE AT YOUR OWN RISK.
Under the laws of most States, an equine activity sponsor or equine professional is not liable for any injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
C. ASSUMPTION OF RISK: I understand that the aforementioned Risks may be caused in whole or in part or result directly or indirectly from the negligence of my own actions or inactions, the actions or inactions of others participating in the DHS Events, or the negligent acts or omissions of the Released Parties defined below, and I hereby voluntarily and knowingly assume all such Risks and responsibility for any damages, liabilities, losses, or expenses that I incur as a result of my participation in any DHS Events. I also agree to be responsible for any injury or damage caused by me, my horse, my employees or contractors under my direction and control at any DHS Event.
D. WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND INDEMNITY: In conjunction with my participation in any DHS Event, I hereby release, waive and covenant not to sue, and further agree to indemnify, defend and hold harmless the following parties: DHS, members, Event participants (including athletes/riders, coaches, trainers, judges/officials, and other personnel), the Event owner, licensee, and competition managers; the promoters, sponsors, or advertisers of any DHS Event; any charity or other beneficiary which may benefit from the DHS Event; the owners, managers, or lessors of any facilities or premises where a DHS Event may be held; and all directors, officers, employees, agents, contractors, and volunteers of any of the aforementioned parties (Individually and Collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s), cause(s) of action, damage(s), loss, or expense (including court costs and reasonable attorney fees) of any kind or nature (“Liability”) which may arise out of, result from, or relate in any way to my participation in the DHS Events, including claims for Liability caused in whole or in part by the negligent acts or omissions of the Released Parties.
E. COMPLETE AGREEMENT AND SEVERABILITY CLAUSE: This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
I HAVE CAREFULLY READ THIS DOCUMENT IN ITS ENTIRETY, UNDERSTAND ALL OF ITS TERMS AND CONDITIONS, AND KNOW IT CONTAINS AN ASSUMPTION OF RISK, RELEASE AND WAIVER FROM LIABILITY, AS WELL AS A HOLD HARMLESS AND INDEMNIFICATION OBLIGATIONS.
By entering a DHS event, I (as the participant or as the Parent/Legal Guardian of the minor identified below) hereby accept and agree to the terms and conditions of this Agreement in connection with my (or the minor’s) participation in any DHS Event. If, despite this Agreement, I, or anyone on my behalf or the minor’s behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties from any such Liabilities as the result of such claim.
The parties agree that this agreement may be electronically signed by entering a DHS event. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.
